1. Eligibility
The Services are available only to users who are 18 years of age or older and reside in the U.S., its territories, or Canada.
2. Services and Service Levels
We provide Services as outlined in your Subscription Order. These may be updated or modified at any time. Access may be unavailable due to maintenance or issues beyond our control. Services are provided “as is” and “as available.”
3. User Accounts and Communications
You are responsible for your account and must protect your login information. Unauthorized use must be reported. Accounts are non-transferable. You consent to receive electronic communications, which you may opt out of (non-essential communications only). We may suspend your account at our discretion.
4. Customer Responsibility and Acceptable Use
You are responsible for all content you submit and all activity under your account. You must comply with these Terms and applicable laws. You may not use the Services to:
Harm individuals or promote harassmentViolate privacy
Spread false information
Misuse identities or likeness
Reverse engineer our technology
Target minors
Bypass safety controls
Use in high-risk scenarios (e.g., life support, air traffic control)
We may suspend your access for violations or risks to platform integrity.
5. Term and Termination
Annual Subscriptions auto-renew unless cancelled with 30 days’ notice before renewal.
Monthly Subscriptions require 30 days’ notice to cancel.
We may suspend or terminate access for non-payment or breach.
6. Fees, Payment & Billing
Subscription Fees are due as per your Subscription Order and are non-refundable.
Annual subscriptions are billed yearly in advance.
Monthly subscriptions are billed monthly in advance.
Payments are processed via third-party providers (e.g., Stripe).
Taxes are your responsibility.
7. Usage Credits and Overage Fees
Each account gets a $50 monthly Usage Credit.
Unused credits expire monthly.
Overage Fees apply if usage exceeds the credit.
Rates include:
Making Calls: $0.0210/min
Receiving Calls: $0.0128/min
Sending Emails: $0.0010/email
Email Verification: $0.0037/verification
Content AI: $0.1350/1000 words; $0.0900/image
SMS Conversation AI: $0.0300/message
Voice AI: $0.1950/min
WhatsApp: $0.1110/message
Reviews AI: $0.1200/response
8. Intellectual Property
All content and software are owned or licensed by us. You receive a limited, non-transferable license to use them for personal or internal business use. You may not copy or distribute without permission.
9. Privacy and Security
Use of the Services is governed by our Privacy Policy. We may analyze anonymized data to improve services.
10. Use of AI Services
AI-generated content is for informational use only. We make no guarantees about accuracy or suitability. You are responsible for:
Verifying content
Legal compliance
Ethical use
Disclosure of how you use AI, if asked
Not using AI for health, safety, legal, or rights-based decisions
11. Third-Party Content
We may link to or integrate third-party platforms. We are not responsible for their content or practices. You interact with them at your own risk.
12. User Content
You retain ownership of content you submit but grant us a license to use it to deliver and improve Services. You represent that your content is legal and you have the rights to use it. We may use your name and logo in marketing. You may request removal of our website credit. We will not use non-public data for training AI without your consent.
13. Disclaimer of Warranties
We provide the Services “as is” and disclaim all warranties. We are not responsible for:
Service interruptions
Errors
Content accuracy
Third-party interactions
External websites
14. Limitation of Liability We are not liable for indirect or special damages. Our total liability is limited to the amount you paid in the last month.
15. Indemnification You agree to indemnify us against claims or losses resulting from your use of the Services, including misuse of AI content or account access by others.
16. Changes to Terms We may update these Terms at any time. Continued use of the Services means you accept the changes.
17. Force Majeure We are not liable for delays caused by events outside our control (e.g., natural disasters, wars, internet failures).
18. Governing Law and Jurisdiction
For Canadian users: Governed by Ontario and Canadian federal law.
For other users: Governed by Delaware law, U.S. Disputes must be brought in the corresponding jurisdictions.
19. Electronic Signatures and Communications Electronic actions (e.g., email, form submissions) count as legal agreements. You agree to receive documents electronically and waive rights to paper documentation.
